Transcript of the video edition

The Justice Department wants a federal judge to block more than twenty thousand mail ballots in California. The reason is a list of voters the government says may not be citizens.

The Justice Department sued California on October fifteenth. It handed the state a list on a thumb drive, and gave the state forty-eight hours to comply or face legal action.

The government says the list includes more than twenty thousand voters who may be noncitizens. It wants their ballots blocked until each person’s status is checked.

California has not complied. State officials cite their own laws. They also say the Justice Department has not released public evidence for its claims.

Attorney General Rob Bonta said twenty-eight people have been charged out of twenty-three million registered voters. He called that a drop in the bucket. Governor Gavin Newsom called the move an attempt to suppress California voters weeks before the midterms.

The strongest case for the government is simple. Federal law bars noncitizens from voting in federal elections, and checking the rolls is a reasonable step to protect that rule.

But the question before the court is narrower and harder. Can a federal demand take ballots that voters already cast out of the count, and on what proof?

So here is the question to watch. Twenty thousand ballots. One federal judge. Who gets to decide?
