Michigan will receive more than $7.2 million from a $220 million national settlement with General Motors over allegations that it shared drivers’ behavior and location data without proper consent, Attorney General Dana Nessel announced Thursday.

A coalition of 36 attorneys general said GM’s Smart Driver program, which ran from 2016 to 2024, passed driving data to data brokers, which supplied it to insurers that used it to set rates, according to the Michigan Advance. The attorneys general argued GM did not properly obtain consent, and in some cases dealership employees allegedly accepted terms on customers’ behalf. FOX 2 Detroit reported that GM’s OnStar app inaccurately told 370,000 drivers they were not enrolled.

The settlement requires GM to get express consent before collecting or sharing covered driver data, to limit what it collects and to build a broader privacy program. GM does not admit liability. A company spokesperson said the agreement addresses Smart Driver, a product it ended in 2024.

“Drivers deserve to know what information about them is being collected and how it may affect their wallets,” Nessel said.
