South Dakota will receive $2,600,792 from a multistate settlement with General Motors over allegations that it sold drivers’ private data, Attorney General Marty Jackley announced Thursday, according to Mitchell Now and South Dakota Searchlight.

Jackley, a Republican, was among 36 attorneys general in the settlement, which Washington and Oregon led, Mitchell Now reported. The states alleged GM collected driving behavior and location data through its Smart Driver program from 2016 to 2024 and sold it to data brokers, which supplied insurers that used it in part to set rates.

GM must get express consent before collecting or disclosing the data and give customers ways to request a copy, delete it and turn off collection of precise location and driving behavior data, South Dakota Searchlight reported. The money goes to the attorney general’s Consumer Protection Fund, which pays for investigations, litigation and future consumer protection work.

“Protecting South Dakotans’ privacy is a priority,” Jackley said. GM said the agreement concerns Smart Driver, a product it ended in 2024.
